تخصيص العام وأثره علي الأحكام الشرعية

Abstract

مستخلص البحث هدف البحث الى التعرف على اثر تخصيص العام من القرآن او السنة مع العلم أن العام على ثلاثة أنواع: عام أريد به العموم و عام أريد به الخصوص و عام مطلق من خلال ذلك استخدمت الطريقة الاستقرئية ثم الاستدلالية ومن ثم اثر تخصيص العام على النصوص وقد توصل البحث إلى عدة نتائج من أهمها: جواز تخصيص العام سواءاً كان خبرا أم أمراً أم نهياً. الاحكام التي نزلت لأسباب خاصة لا تخص من نزلت فيه بل العبرة فيها بعموم اللفظ لا بالخصوص. ما يعتبره الاصوليين تخصيصاً بالعقل هو في الحقيقة تخصيص بالمعنى لا بدلالة اللفظ. أن القياس دليل من ادلة الشرع حيث أنه مظهر للحكم لا مثبت له، و لذلك يجوز التخصيص إذ يكون التخصيص بالدليل المقيس على حكمه في الحقيقه.

Abstract This research aimed at identifying the impact of specifying the general in the Quran and Sunna. The general is of three kinds: one for generalization, one for specifity and one for ultimate. The research used the deductive and inductive methods and came out with some results. Here are some of the important ones: 1- The permission of specifying the general whether its predicate, order, or prohibition. 2- The rules which have been revealed to the prophet do not concern the immediate event, but they are generalized. 3- What the fundamentalist regard as specification by the mind, is in reality specification by meaning. 4- Analogy is one of the law proof, because it’s one of the aspects of judgment. Therefore, it is permissible to specify.
