موانع المسؤولية الجنائية (دراسة مقارنة)

Abstract

مستخلص البحث موانع المسؤولية الجنائية موضوع يطول شرحه نسبة لتعدد هذه الموانع لذلك لا يمكنني القول بأني قد أوفيت الموضوع حقه، فهذه الدراسة نبذة بسيطة ، فيمكن القول بأن موانع المسؤولية الجنائية هي الأسباب التي تعترض الفاعل بالذات فتشيب إرادته وتعيبها كالإكراه، أو تعدمها كالجنون، أو تنقصها كالصغر، أو هي تلك الأسباب التي تفقد الشخص قدرته علي التميز والاختيار فتجعله غير أهل لتحمل المسؤولية الجنائية . وهي ما يصيب الإرادة أو الوعي سواء كانت أعراض الوعي طارئة كالجنون والسكر والمخدرات، أو أساسية كالصغر أو ما يصيب الإرادة بظروف طارئة كالإكراه وحالة الضرورة. وبهذا يمكن حصر موانع المسؤولية الجنائية بالحالات التي تسبب فقد الإدراك أو الإرادة أو كليهما. إذا موانع المسؤولية الجنائية ذات صفة شخصية تتعلق بالشخص نفسه ولا تتعدي لشركاء الفاعل كما أنها لا تنفي عن الفعل الصفة الجريمة ويبقي الفعل يشكل جريمة إلا أنها ترفع المسؤولية الجنائية عن الفاعل مع بقاء المسؤولية المدنية قائمة.

Abstract The obstacles of criminal responsibility is a big topic to explain because of the multiple hindrances that they have. Therefore, the researcher could not cover the whole topic. This study is a brief account of the topic. These obstacles are considered the reasons that object the doer and negatively affect his will, like compulsion or get rid of it like madness, or even reduce it like teenage. In other words, it may be those causes which make someone lack ability to discriminate or choose , thus make him unviable to bear criminal responsibility. It may also be the factor that will affect or awareness whether its symptoms are emergent like madness, drunkenness or drugs or basic like teenage , or may be those symptoms which are temporal like compulsion or a case of necessity . Thus one can summarize the hindrances of criminal responsibility in the cases that cause lack of awareness or will, or both. The obstacles of criminal responsibility have personal threatens related to the person himself , not that ones …..may be attributed to the partners. It also does not negate the crime of the action , but it remains a crime after all. However it gets rid of the criminal responsibility from the doer while the civil liability still remains.
