مركز الأجانب في التشريعات السودانية (دراســة مقارنــة)

Abstract

مستخلص البحث تهدف هذه الدراسة إلى التعرف على الأجنبي، وحقوقه وواجباته وإقامته في الدولة، ودخوله وخروجه، وحمايته أيضاً، كذلك العقوبات التي تقع عليه في حالة مخالفة قوانين الهجرية وأي جرائم معاقب عليها وفق قوانين الدولة . وإتبعت في هذه الدراسة المنهج الوصفي التحليلي الذي يستند جمع المادة وتحليلها ودراستها وإستنباطها وتنظيمها وعرضها بشكل يساعد على إستيعابها كذلك إتبعت منهج المقابلة . وقد توصل البحث إلى إستخلاص مهم يتلخص في الآتي : أن الشريعة الإسلامية لم تهمل كل ما يخص الأجنبي حيث نظمت حقوقه وواجباته وكيفية حمايته، كذلك لابد من معالجة الوجود الأجنبي غير المشروع للتقليل من وقوع الجرائم والأمراض وغيرها من الآثار السلبية التي تنعكس على الدولة نفسها وعلى مواطنيها والحمد لله تعالى وبفضله تم هذا البحث بعد أن أمعنت النظر في جوهر الموضوع وحقيقته وأبعاده . كما توصل البحث إلى عدة توصيات أبرزها، ضرورة إجراء الفحص الطبي لكل أجنبي يبدئ رغبته في دخول السودان حفاظاً على سلامة المواطنين والأجانب المقيمين الآخرين، كذلك لابد من إنشاء نيابات خاصة بالأجانب، وسجون خاصة بعيدة عن المواطنين، كذلك توصل الباحث إلى ضرورة النظر في تجارب الدولة المتحضرة والمتقدمة في كيفية حصر الأجانب وكيفية معاملتهم وكيفية توقيع عقوباتهم .

Abstract This study aims to identify the foreign rights and duties, residence in the country, entry and exit to and protect it as well. As well as the penalties incurred by itself in the event of any irregularities migration punishable offenses in accordance with the law of the State . In this study descriptive and analytical approach was followed which is based on the collection of data, analyze, studying, devised, organized and displayed to be well understood. The research has concluded: That Islamic law did not neglect everything related to foreign as it guaranteed their rights and define their duties. It is necessary to address the foreign presence is the project to reduce the incidence of crime, disease and other negative effects on the state itself and its citizens. This research found several recommendations highlighted in the following: The necessity of a medical examination for every foreigner show the desire to enter Sudan, in order to preserve the safety of citizens and other foreigners. Set up special prosecutors to foreigners and private prisons away from citizens. The country must consider the experiences of developed countries with foreigner’s treatment.
