الآليــــــــــات القــــــانونية لمكافــحة الفـــــــــساد دوليـــاً ووطنياًً

Abstract

مستخلص البحث بحثت مشكلة الفساد بشكل عام مع أ المنهج الوصفي ، والآليات القانونية المستخدمة لمكافحته دوليا ووطنيا ، ومن خلال التعرف على أسباب الفساد وأنواعه وآثاره ، ثم طرحه بعض تجارب الدول والتشريعات المحلية لمكافحة الفساد وحصاره وفعالية مثل هذا التشريع ل الحد من الفساد ، وكذلك الجهود الدولية لمكافحة الفساد الذي تمثله الاتفاقيات الدولية والإقليمية ومدى التزام الدول بأحكام تلك الاتفاقات ، وخاصة اتفاقية الأمم المتحدة ضد الفساد في إطاره العام ، كما تناولت الدراسة تجربة بعض الدول العربية والأجنبية وجهود تلك البلدان في مواجهة الفساد والأطر القانونية اعتاد كبح هذه الظاهرة ، كما أشار البحث إلى أن مشكلة الفساد هي ظاهرة عالمية حيث لا توجد دولة أو مجتمع خال من الفساد ، وأن هذه الظاهرة انتشرت فيها البلدان النامية على نطاق أوسع مما هو الحال في البلدان المتقدمة ، التي تتميز بمستوى معيشة جيد واقتصادي الاستقرار السياسي ، ثم قدم البحث نتائج و توصيات لمعالجة هذه الظاهرة Abstract The research tackled the problem of corruption in general with a descriptive approach، And the legal mechanisms used to combat it internationally and nationally، And through the identification of the causes of corruption and its types and effects, and then put forward some of the experiences of States and domestic legislation to combat corruption and its siege and the effectiveness of such legislation to reduce corruption، As well as the international efforts to combat corruption represented by the international and regional conventions and the extent of the commitment of countries to the provisions of those agreements, particularly the United Nations Convention against Corruption in its general framework، The study also dealt with the experience of some Arab and foreign countries and the efforts of those countries in confronting corruption and the legal frameworks used to curb this phenomenon، The research also pointed out that the problem of corruption is a global phenomenon as there is no state or society free from corruption، And that this phenomenon spread in developing countries more broadly than in developed countries, which are characterized by good living standards and economic and political stability، The research then presented findings and recommendations to address this phenomenon
