الإجمــاع في المـذهـب الحـنبلي (دراسة أصولية تطبيقية)

Abstract

مستخلص البحث يهدف هذا البحث إلى بيان مكانة الإجماع في مصادر التشريع . وكذلك يهدف إلى إبراز جهد إمام من أئمة الفقه والحديث في علم أصول الفقه عن طريق جمع مسائله الأصولية المنصوصة عنه.وكذلك الوقوف على مدى توافق واختلاف آراء العلماء فيما يختارونه من أصول وفروع فقهية، وذلك من خلال ربط الأصول بالفروع.وبيان منهج العلماء في التعامل مع الإجماع. اتبعت الباحثة في هذا البحث المناهج التالية :- جمع المسائل الفقهية المبنية على أصل الإجماع . توثيق الآيات القرآنية . تخريج الأحاديث النبوية تخريجاً علمياً كاملاً. نسبة كل قول إلى قائله . توصلت الباحثة إلى عدد من النتائج من أهمها : الإجماع أصل عظيم من أصول الشريعة الإسلامية ولا يمكن الاستغناء عنه. توافق آراء علماء المذهب الحنبلي بين الاختيارات الأصولية والآراء الفقهية. ومن خلال نتائج البحث توصلت الباحثة إلى عدد من التوصيات من أهمها: أوصي بمزيد من الدراسة لأمثال هذه الموضوعات ، وتشجيع البحث فيها ، وحث الطلاب على التسابق للاشتغال بمثل هذا النوع من البحوث حتى يتبين الإجماع الصحيح من المدعى خدمة للعلم وأهله . أوصي نفسي أولاً وطلاب العلم والعلماء خاصة بالاجتهاد في تعلم علم أصول الفقه وتعليمه أن لا يتكلموا في مسألة ليس لهم فيها إمام ، والاعتناء بجمع ودراسة مسائل فيها اثر الرجوع إلى فقه السلف الصالح وهم أقرب الناس إلى الفهم الصحيح إلى نصوص الكتاب والسنة ومقاصد الشريعة .

Abstract The purpose of this research is to indicate the status of consensus in the sources of legislation . As well as aims to highlight the effort of the imams of jurisprudence and Hadith in the science of the fundamentals of jurisprudence by collecting the fundamental issues set forth . As well as aims to determine the compatibility and divergence of the views of scientists choose the assets and branches of jurisprudence ,and by linking the assets branches .And the approach of scientists in dealing with consensus the researcher followed the following approaches: the collection on the origin of unanimity . Documentation of Quranic verses .Graduation of the prophet's Hadiths completely. Percentage of eash statement to the author. The researcher came to a number of results,the most important of which is: consensus is a great asset of Islamic law and can not be dispensed with. The views of Hanbali scholars agree with the fundamentalist and jurisprudential choices. Through the results of the research . the researcher reached a number of recommendations, the most important of which are : she recommend further study of such subjects, encouraging research and urging students to race with this type of research until the correct consensus of the respondent is found to serve the science and its people . she recommend herself first and students of science and scholars especially diligence in learning the fundamentals of jurisprudence and teach them not to speak in a matter where they do not them, and to take care of the collection and study of matters in which the impact of reference to the jurisprudence of the righteous advances and they are the strangest people to the correct understanding of the texts of the Koran and Sunnah.
